Product Warranty

 

Manufacturer’s One-Year Limited Warranty

Magical Brands, Inc. (“Magical Brands”) warrants that its products will be free from manufacturing defects for one year from the date of purchase or date of delivery (if later than the date of purchase). Because Magical Brands cannot control the quality of products sold by unauthorized sellers, this warranty applies only to products that were purchased from Magical Brands or a Magical Brands authorized seller in the United States, unless otherwise prohibited by law. Magical Brands reserves the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized Internet sites/marketplace storefronts.  

This warranty extends ONLY to the products’ original, end-user purchaser in the United States.

This warranty does not cover product that has been damaged by accident, unreasonable use/misuse, neglect, improper service, commercial use, repairs by unauthorized personnel, or other causes not arising out of defects in manufacturer’s materials or workmanship. This warranty does not extend to any units which have been used in violation of written instructions in this Owner’s Manual, units that have been used to violate any state or federal laws or to units which have been altered or modified or to damaged products or parts that have the serial number removed, altered, defaced, or rendered illegible.

Warranty Disclaimers: There are no express warranties which extend beyond those stated herein and no representative or person is authorized to assume for Magical Brands any other liability in connection with the sales of our products. ANY IMPLIED WARRANTIES THAT MAY BE APPLICABLE TO PRODUCTS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. UNDER NO CIRCUMSTANCES SHALL MAGICAL BRANDS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF THIS LIMITED WARRANTY, BREACH OF CONTRACT OR STRICT LIABILITY.  Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.  

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

Warranty Performance: During the warranty period, a product with a defect will be either repaired or replaced with a reconditioned comparable model (at Magical Brands’ option) when the product is returned to Magical Brands. The repaired or replacement product will be in warranty for the remainder of the original warranty period.

To Make a Claim or for In-Warranty Service: Contact Magical Brands here or write to us at 1214 W Cass Street  Tampa, Florida 33606. When completing the form or upon request of Magical Brands, you may be required to provide proof of purchase (and proof of delivery date if different than date of purchase), a full description of the defect, and photographic proof of the defect. Magical Brandsmay also require you to return the product to us. Purchaser will be responsible for shipping costs to return the product to us. Magical Brands will pay for return shipping to the consumer. The warranty does not cover damage during your shipping to the service location, please ensure proper precautions are taken.
